Work Patent Renewal: A Guide

The validity period of a work patent is a maximum of 12 months. When it comes to an end, a foreign citizen has two options: renew the patent with advance payments of personal income tax or reissue it for a new term. Both options allow you to continue working legally in Russia without leaving the country.

Renewal and Reissue: What’s the Difference

In colloquial speech, both processes are called “patent renewal,” but legally these are different procedures.

Patent renewal is the monthly payment of an advance payment for personal income tax. As long as you pay on time, the patent is valid. No need to contact anyone. The maximum validity period under this scheme is 12 months from the date of issue.

Patent reissue is obtaining a new patent for the next 12 months. This is a full-fledged procedure: you need to collect documents, get a petition from the employer, and submit an application to the Ministry of Internal Affairs.

The scheme looks like this: obtaining a patent → 12 advance payments → reissue → new patent → again 12 payments → again reissue. The number of cycles is not limited.

How to Renew a Patent with Advance Payments

Renewal through advance payments is the simplest way to keep the patent valid. Here’s what you need to know.

Amount of Advance Payment

The amount depends on the region. It consists of a fixed payment (1,200 ₽), a deflator coefficient, and a regional coefficient.

Payment Rules

  1. Pay strictly before the start of the paid period. For example, if the patent started on March 15, the next payment must be made by April 15.
  2. You can pay for several months in advance (up to 12 months).
  3. Payment is accepted through a bank, terminal, State Services portal, or banking application.
  4. Keep all receipts — they will be needed when reissuing the patent.

What Happens if You Miss a Payment

A delay of even one day automatically cancels the patent. This is not a fine — it is a complete loss of the document. After cancellation:

  • you cannot work with such a patent;
  • you need to leave Russia and apply for a new patent from scratch;
  • working without a valid patent is subject to a fine from 5,000 to 7,000 ₽ with possible expulsion.

Notification of the Ministry of Internal Affairs

After each payment, the receiving party (employer) must notify the territorial department of the Ministry of Internal Affairs about the extension of the employee’s stay. The deadline is 3 working days. The notification form is arbitrary, with a copy of the payment receipt attached.

Reissuing a Patent for a New Term

When 12 months have passed and all advance payments have been paid, you need to reissue the patent — in fact, get a new document.

Conditions for Reissue

You can reissue a patent without leaving only if all conditions are met simultaneously (p. 9 art. 13.3 FZ-115):

  • all advance payments for the previous patent are paid without omissions;
  • there is a valid employment contract or civil contract;
  • the employer is ready to submit a petition for reissue;
  • documents are submitted to the same Ministry of Internal Affairs where the patent was issued;
  • the foreign citizen is legally in Russia.

If at least one condition is not met — reissue is impossible.

  1. Application for patent reissue (form approved by the Ministry of Internal Affairs order)
  2. Employer’s petition — an official appeal to the Ministry of Internal Affairs with a request to reissue the patent to the employee
  3. Passport with a notarized translation into Russian
  4. Photo 3×4 cm — 1 pc.
  5. Valid patent + all receipts for advance payments
  6. VHI policy for the new term (or a contract for paid medical services)

  8. Certificate of knowledge of the Russian language, history, and legislation of the Russian Federation (if the previous one has expired)
  9. Employment contract or civil contract with the employer

Employer’s Petition

This is a key document. Without it, reissue is impossible. The petition is prepared by the employer (head of LLC, individual entrepreneur, or individual employer), not the employee.

The petition specifies:

  • full details of the employer (name, TIN, OGRN, address);
  • full name, date of birth, citizenship, and passport details of the employee;
  • profession — must match the one specified in the patent and employment contract;
  • subject of the Russian Federation where the foreigner works.

Common mistakes in the petition, due to which they refuse:

  • the company name does not match the name in the employment contract;
  • another profession is indicated;
  • the wrong region is indicated (Moscow instead of the Moscow region — these are different subjects).

Deadlines for Submitting Documents

Documents for reissue must be submitted no later than 10 working days before the end of 12 months from the date of issue of the patent.

But 10 days is the deadline. In practice, start preparing 1–1.5 months in advance:

The Ministry of Internal Affairs considers the application for 10 working days. If the decision is positive, you undergo fingerprinting, photographing, and receive a ready patent.

What to Do if You Miss the Deadline

If 12 months have passed and the documents have not been submitted — reissue of the patent is impossible. The law does not provide for exceptions.

The only way out:

  1. Leave Russia.
  2. Re-enter with a migration card (purpose — “work”).
  3. Apply for a new patent from scratch: medical examination, exam, all documents.

Important: from February 2026, the visa-free stay period is limited to 90 days in total per calendar year (if there are no grounds for extension). The patent is the basis for a longer stay, so timely reissue is critically important.

How the Employer Credits Payments

The employer can reduce the withheld personal income tax from the salary by the amount of your advance payments. To do this, he sends a statement to the tax office and receives a notification of the right to offset. This means that you do not actually pay personal income tax twice.

Actions After Receiving a New Patent

After reissue:

  1. Provide the employer with a copy of the new patent.
  2. Check the data: full name, profession, subject of the Russian Federation — everything should match the employment contract.
  3. Set up regular payment of advance payments for the new patent.
  4. Keep all receipts — they will be needed in a year for the next reissue.
  5. To receive a salary, make sure you have a bank account .
