Entry Ban for Administrative Offenses: What They Are Imposed For and How to Remove One

Many foreigners learn about an entry ban not because of a criminal record or deportation, but because of ordinary administrative fines. Two or three “minor” violations in a year — and a person is placed in the register of controlled persons and refused entry at the border. It may seem unfair, but this is a direct consequence of the law on the legal status of foreign citizens (114-FZ).

The main mistake is to consider fines insignificant. An expired registration, working without a patent, exceeding the permitted period of stay, traffic violations — all of this adds up. And when enough violations accumulate, the Ministry of Internal Affairs decides to deny entry. Below, we explain exactly what entry bans are imposed for, which violations are the most dangerous, and what to do if a ban has already been imposed.

In Brief: What to Do

  1. Check whether you have an entry ban using the official Ministry of Internal Affairs service and a written request — online data is for reference only.
  2. Count your violations over the past year: how many decisions were issued and whether the fines were paid.
  3. Determine the grounds: most often, it is two or more administrative offenses within one year.
  4. If a ban has been imposed, determine whether it is lawful: whether the limitation period has expired and whether there were procedural violations.
  5. Pay all fines and keep the receipts — this is important both for challenging the ban and for its early removal.
  6. Appeal the decision (if there are grounds) through the court or apply for early removal due to changed circumstances.
  7. Do not leave the country or plan an entry until the ban is removed — a repeated refusal worsens your situation.

What Entry Bans Are Imposed For: Grounds Under the Law

An entry ban (denial of entry) is regulated by Federal Law No. 114-FZ “On the Legal Status of Foreign Citizens in the Russian Federation.” With regard to administrative offenses, the key ground is two or more administrative offenses within one year. Violations related to the migration regime are considered particularly serious.

The most “dangerous” violations from the standpoint of an entry ban are:

  • violation of the stay regime — expired registration or exceeding the permitted period of stay in Russia;
  • working without a patent or permit or outside the permitted region;
  • violation of entry/exit rules, including exceeding the period of stay under the 90/180 rule;
  • repeated traffic violations, especially while intoxicated;
  • unpaid fines and administrative debts.

Important: a criminal record is not required for an entry ban. Administrative decisions are sufficient. This is precisely why a person with a “clean” record but two fines in one year may be refused entry just like someone with serious violations.

Which Violations Are Considered “Repeated”

The law refers to two or more offenses within one year. At the same time, decisions that have entered into legal force are taken into account. The limitation period for bringing someone to administrative liability under most articles is two months (three months for some), but for the purpose of deciding on an entry ban, what matters is the existence of decisions within the calendar year.

The practical conclusion is this: even if a fine has been paid, the decision itself remains in the database and is taken into account. Payment mitigates the situation but does not cancel the fact of the violation. Therefore, it is better not to accumulate violations but to resolve each one as it arises.

Why Entry Bans Are Often Imposed “Out of Nowhere”

A typical situation: in summer, a person overstayed by several days; in autumn, exceeded the speed limit; in winter, worked for a week without extending their patent. Each case seems minor. But formally, these are three administrative offenses in one year — which means there are grounds for denying entry.

An entry ban is often imposed after a person has already left Russia, and they learn about it when trying to return. Therefore, you should check whether a ban exists before every trip, not only when problems arise.

How to Check for an Entry Ban

There are two ways:

  1. Online service of the Ministry of Internal Affairs (гувм.мвд.рф) — quick and free, but for reference only and does not always reflect up-to-date information.
  2. A written request to the Ministry of Internal Affairs — provides an official response stating the grounds, date of the decision, and duration of the ban. This is a reliable document for further action.

The response should state who made the decision and when, on what grounds (which violations), and for how long. If this information is missing, it should be requested separately; without it, it is impossible to determine a strategy for removing the ban.

More information about checking is available in the separate article how to check an entry ban .

How to Remove an Entry Ban for Violations

There are two options, and the choice depends on whether the decision is lawful.

The first option is to challenge it. If there were fewer than two decisions, if the limitation period has expired, if the violation was not proven, or if the procedure for imposing liability was violated, the entry-ban decision can be overturned through the court. An administrative claim is filed with the court at the location of the Ministry of Internal Affairs body that issued the decision. The deadline for filing is three months from the date the person learned that their rights had been violated.

The second option is early removal. If the decision is lawful but circumstances have changed, an application for early removal is submitted to the same authority. Arguments may include payment of all fines, legal employment and a valid patent, family in Russia, a prolonged absence of violations, and payment of taxes. The full procedure is described in the article how to remove an entry ban .

In both cases, the application should be accompanied by: a passport with a translation, copies of the decisions, receipts confirming payment of fines, documents confirming legal status (patent, temporary residence permit, registration), and evidence of family circumstances.

What to Do to Avoid an Entry Ban

Prevention is easier than a cure:

  • monitor registration and permitted-stay deadlines and set reminders;
  • work legally — extend your patent on time and pay for it;
  • pay fines immediately and keep the receipts;
  • check your status before leaving Russia, especially if you have had violations during the year;
  • do not accumulate “minor” violations — two of them are already grounds for an entry ban.

Frequently Asked Questions

Can entry be banned for one fine?
As a rule, the grounds are two or more offenses within one year. However, there are separate serious grounds (for example, a violation related to security) where one offense is sufficient. Everything depends on the specific article and circumstances.

Does paying fines help?
Payment does not cancel the decision, but it demonstrates good faith and is taken into account when considering early removal. Paid fines are an essential argument in your favor.

How many years does an entry ban for violations remain in effect?
The duration depends on the grounds and is specified in the decision. It is often three years, but it may be longer in the case of repeated decisions. Only an official response from the Ministry of Internal Affairs can provide the exact end date.

Can I leave if an entry ban has already been imposed?
Leaving Russia is generally not prohibited, but re-entry is blocked. However, it is better not to take risks and first clarify your status: an attempted entry while an active ban is in place is recorded and worsens your position.

What if the violations occurred a long time ago?
The existence of decisions within the year preceding the decision is taken into account. Older violations do not count directly, but they may affect the assessment. If the limitation periods have expired, this is an argument for challenging the decision.
